Arizona Supreme Court to rule on Scottsdale DUI results

SCOTTSDALE, AZ – The Arizona Supreme Court issues a decision Thursday on whether a lower appellate court was correct to rule that Scottsdale police crime lab results of blood-alcohol tests could be used as evidence against nearly a dozen DUI defendants.

The state Court of Appeals’ decision had erased a Maricopa County Superior Court judge’s ruling on the reliability of blood-testing equipment used by the Scottsdale crime lab.

The Superior Court judge ruled that the lab hadn’t properly applied testing principles and that the blood tests for the defendants could not be used.

However, a Court of Appeals panel ruled that the results were admissible and it lifted a legal hold on the defendants’ cases so they could proceed.

However, the Supreme Court agreed in January to review the Court of Appeals ruling.
